Acceptable Use Policy

Elaborates on how we expect our services to be used.

All customers using our services must agree to this policy; this comes in addition to our Terms of Service.
The Acceptable Use Policy (AUP) is provided to give our customers a clear understanding of what we expect of them while using our services.

This page is intended to provide a basic understanding of this policy. The following subjects are guidelines for the establishment and enforcement of our Acceptable Use Policy:
- Ensure reliable service to our customers;
- Ensure security and privacy of our systems and network, as well as the networks and systems of others;
- Comply with existing laws;
- Maintain reputation as a responsible service provider;
- Encourage responsible use of the internet and discourage activities which reduce the safety and value;
- Preserve the privacy and security of individual customers and/or organizations;
- Maintain the reputation of IP Addresses active on our IP Address Market

1. Violations of our Acceptable Use Policy

The following types of abuse aggregate violations of this Acceptable Use Policy:
- Copyright infringement;
- Malware or Phishing;
- SPAM or unsolicited email;
- Unacceptable/Illegal materials;
- Other: Anything else that doesn’t fall under any of the categories above.

2. Reporting Abuse

If any activity is deemed worthy reporting to the Steadcloud Abuse Department, there are two ways to do this:
- By creating a case in our portal (Abuse Department);
- By using our contact form https://steadcloud.com/abuse/report;

If available, the following information should be provided:
- The IP address (obligatory) and domain (if available) used to commit the alleged violation;
- The date and time of the alleged violation, including the time zone or offset from CET;
- Any available evidence of the alleged violation: email headers, logs (plain text where possible) or screenshots;

Lack of adequate evidence will result in Steadcloud's inability to resolve the issue. The Abuse Department's default languages are in Dutch and English.
We do not actively observe subscriber activity under normal circumstances. Similarly, we do not exercise editorial control over the content of any website, e-mail communication, newsgroups, or other material created or accessible over or via our services.
However, in accordance with our Terms of Service any materials that, in our sole discretion, may be illegal, may subject us liability, or which may violate this AUP can be removed.

3. Law enforcement

Steadcloud may cooperate with legal authorities and third parties to investigate any suspected or alleged crime or civil wrongdoing. A customer's violation of this Acceptable Use Policy may result in the suspension or immediate termination of either customer's Steadcloud account or other actions.
Should Steadcloud receive a take-down request from the trusted hotlines – Steadcloud will proceed with an immediate take-down.
Any legal order or warrant should be submitted to our Abuse Department by the following contact form: https://steadcloud.com/abuse/report. Suppose a customer account is used to violate the Acceptable Use Policy or Terms of Service; Steadcloud reserves the right to terminate the customer service without notice. Steadcloud prefers to advise customers of inappropriate behavior and any necessary corrective action; however, flagrant violations of the Acceptable Use Policy will immediately lead to the termination of the customer account. Steadcloud's failure to execute this policy, for whatever reason, shall not be construed as a waiver of Steadcloud's right to do so at any time.

4. Handling timelines

Steadcloud expects customers to react to abuse cases immediately and follow up if no action is taken. However, suppose we do not receive any response from the customer within the given timeline. In that case, the services might be subject to suspension until further notice or termination based on the issue's severity.
- Spam, Spamvertisement, Malware – 24h;
- Copyright infringement, Phishing – 48h;
- Any other types of abuse – up to 48h

5. Important remarks

Anyone hosting web sites or services on their server, that support spammers or cause any of 3rd party’s IP space (which is available on our IP Address Market) to be listed in any of the various Spam Databases or blacklists will have their IP lease immediately suspended.

Upon the occurrence of an abuse and at any time thereafter, Steadcloud may exercise from time to time any one or more of the following remedies:
(a) terminate the related service as to any portion or all of the services;
(b) use, lease or otherwise dispose of any or all of the IP addresses leased in such manner as Steadcloud in its sole discretion may decide;
(c) accelerate the due date of all remaining service payments due hereunder for the entire remaining initial period of related service;
(d) recover the sum of: (i) any accrued and unpaid fees, plus (ii) the present value of all future fees reserved in this Lease and contracted to be paid over the unexpired Initial Period of the Lease (or any renewal period then in effect); plus (iii) all costs and expenses incurred by Steadcloud in any repossession, recovery, re-lease or other disposition of the IP addresses, including but not limited to costs of administration, advertising and broker’s fees together with all attorney’s fees and cost incurred in connection therewith or otherwise resulting from IP User’s default (including any incurred at trial, on appeal or any other proceeding) (h) exercise any other remedy permitted by law.

The customer will not be able to use our services until you agree to remove any traces of the offending material immediately. Upon unsuspension, you agree to allow us access to the related service to confirm that all material has been eliminated. Severe violations may result in immediate and permanent termination of the corresponding customer without notice to the customer.

6. Revisions to the Acceptable Use Policy (AUP)

Steadcloud reserves the right to revise, amend, or modify this Acceptable Use Policy and our other policies and agreements at any time and in any manner.
